What is negligence?

Negligence is the failure to use ordinary or reasonable care. In a lawsuit based on a negligence claim, the plaintiff has the burden of demonstrating that the defendant had a duty of ordinary care to the plaintiff (to either act in a certain way or to refrain from acting in a certain manner), that the defendant breached that duty, and that the breach caused injury to the plaintiff.  The "prudent person" standard is a norm under which a court or jury evaluates what a prudent or reasonable person would do under similar circumstances.

The  San Luis Obispo accident injury law firm of Brenneman, Juarez and Adam, LLP focus their efforts on achieving a fair trial for their clients during complex legal proceedings in similar lawsuits.
