What is negligence?
Negligence is the failure to use ordinary or reasonable care. In a lawsuit based on a negligence claim, the plaintiff has the burden of demonstrating that the defendant had a duty of ordinary care to the plaintiff (to either act in a certain way or to refrain from acting in a certain manner), that the defendant breached that duty, and that the breach caused injury to the plaintiff. The "prudent person" standard is a norm under which a court or jury evaluates what a prudent or reasonable person would do under similar circumstances.
