Construction Company Settles Trench Collapse Suit

A Connecticut-based construction company reached a settlement agreement with the Occupational Safety and Health Administration (OSHA) after one of its employees died when a trench collapsed around him. OSHA initially fined Sosa Construction $17,000 for violating safety standards, but later reduced the penalty to $8,700 when the company appealed.

Journalist Debra Friedman noted in "Stamford construction company fined for fatal Greenwich accident" that OSHA agreed to a reduced settlement because Sosa was a smaller employer and business had been slow for them during the previous winter.

Construction Company Ignores $1.9 Million Settlement to Injured Worker

A Eugene, Ore., construction worker was awarded a $1.9 million settlement for injuries he sustained while on the job for Minaean Power Structures (USA) Inc. Danny Davis was seriously hurt when he fell through an unmarked, third-floor hole at a construction site.

Karen McCowan reported in "Worker still awaits cash for injury" that the company refused to pay the judgment and previously had ignored a series of orders issued by local judges in the case.

Davis' attorney filed a Piercing the Corporate Veil complaint against the U.S. division of the Canadian firm. To further complicate matters, the Canadian firm had set up a shell corporation in Oregon and had no actual offices in the United States.

General Contracting Firm Settles with Crane Operator in Deadly Crane Collapse Suit

A former crane operator received a $1.45 million settlement for injuries he suffered in the deadly collapse of a construction crane in Bellevue, Wash. Warren Yeakey was left permanently disabled and unable to work.

Steve Miletich and Jennifer Sullivan reported on the event in "Jury awards crane operator $1.45 million in deadline Bellevue collapse." A jury found Lease Crutcher Lewis and Magnusson Klemencic Associates (MKA) responsible for the accident and negligent.

Yeakey was awarded $1.1 million in actual damages and an additional $300,000 in punitive damages for pain and suffering. The amount was much less than the $12 million he had sought.
