New Hampshire DUI Law & Drunk Driving Convictions

DWI law can be complicated to navigate without an experienced New Hampshire DUI lawyer on your side. In New Hampshire, you are considered to be driving intoxicated if you have a blood alcohol concentration (BAC) of .08 or greater. This is the standard measurement for drivers across the U.S. for impaired drivers. New Hampshire DUI law has a lower BAC limit for drivers of commercial vehicles and drivers under the age of 21 is lower. First time New Hampshire drunk driving convictions result in fines up to $500 and a 9 to 2 month license suspension. A suspension must be followed by an impaired driver intervention program in which the convicted driver incurs the costs. It is at the courts discretion if the driver is ordered to a drug & alcohol treatment program which can require them to random urinalysis submissions.

Second drunk driving convictions in New Hampshire results in a 10 day minimum jail sentence, a fine up to $750, and a 3 year revocation of ones drivers license. The license suspension is then followed up by a 7 day DWI offender intervention detention program, again at the expense of the convicted.
A third DWI conviction results in an indefinite suspension of ones drivers license for a minimum of 5 years. This is also accompanied with a 180 day minimum in the county correctional facility and a 28 day residential treatment program paid by the convicted driver. The court can also order a drug and/or alcohol treatment program requiring random urinalysis.
