I had a client who was a lawful permanent resident for 18 years.  He had committed two minor theft offenses.  The offenses are considered crimes involving moral turpitude.  He was placed in removal proceedings.  It came up that he also had a 1988 offense that was considered an aggravated felony.

If one has an aggravated felony he is not eligible for any relief.  I had to attack the validity of that 1988 conviction arguing it was not an aggravated felony due to the fact that the California statute my client was convicted under was inconsistent with the federal definition of the same offense.

As my argument's decision was pending, the 9th Circuit court of appeals issued an opinion in a similar case stating that the same statute is not an aggravated felony and therefore my client was granted a waiver and the right to remain in the US.
