How Is Criminal Law Unique in Chicago?

Felony and misdemeanor classifications in Chicago are quite different from those elsewhere in the country. Additionally, the repercussions for committing certain crimes are significantly different in Chicago than in other cities across the nation.

Criminal laws in Chicago

Some criminal laws that are unique to Chicago include the following:

  • Marijuana:  In Chicago, possession of a small quantity of marijuana is considered a misdemeanor and is punishable for up to one year in prison and a $2,500 fine. Cultivation of five plants or less is a misdemeanor and punishable for up to one year in prison and a $2,500 fine.
  • DUI:  If you are stopped for DUI in Chicago, you should know that the "Per Se" blood alcohol concentration (BAC) level is .08, the "Zero Tolerance" BAC is .00, and the "Enhanced Penalty" BAC level is .20. Furthermore, under criminal laws in Chicago concerning DUI charges, there is an implied consent.
  • Gambling:  Other than on Lake Michigan, riverboat gambling is allowed on any navigable stream, except within counties with a population over 3 million.
  • Capital punishment and the death penalty:   Chicago allows the death penalty for offenders who are at least 18 years old and have committed treason or capital homicide.
