San Francisco Elder Abuse Settlement
Doe, C.P.A., Former Trustee, was Decedent's trusted friend whom she had known since he was a boy and lived across the street from her. Decedent had no children of her own and named Doe as the trustee of her trust. After decedent moved to a rest home, Doe looted her trust of $300,000. Attorney brought suit to remove and replace Doe as trustee, as well as for fraud, conversion and financial elder abuse.
At trial, Doe contended that he had properly used his power under the trust to make investments in his own internet start-up which ultimately failed. After the trial, the court awarded judgment against Doe in the full amount of $300,000, plus $30,000 punitive damages, plus interest, attorneys' fees and costs. Attorneys have successfully collected over $300,000 thus far. This was the first financial elder abuse trial in San Francisco County. Las Vegas Family Law Firm
Benefits of Using a Local Las Vegas Family Law Firm
Las Vegas family law cases are often the most difficult for clients to face because they involve people that are extremely close and can decide the future of the entire family. A number of legal situations that necessitate the use of a family law firm include:
- Divorce
- Child custody
- Adoption
- Grandparent rights
- Termination of parental rights
- Post-judgment modifications
If you are faced with any of these situations, it is beneficial to retain a lawyer from a local Las Vegas family law firm for many reasons:
- Having a lawyer from a local Las Vegas family law firm means you will not have to travel out of town to meet with your lawyer, thus cutting down the time and cost you must devote to your case.
- Las Vegas family law firms employ lawyers that understand the local and state laws and stay up-to-date on changing litigation in the surrounding area to better serve you and your case.
- A lawyer in your local area knows other law firms, lawyers, and judges in Las Vegas. This will expedite an out-of-court settlement, if your case calls for it.
- A local firm will be familiar with neighborhood resources in your area like support and advocacy groups.
- If your law firm is a local family law firm in Las Vegas and you are required to drop off or pick up legal documents related to your case, you will not have to travel far to perform this task.
- If your family law case involves division of property, it is beneficial to have a law firm in Las Vegas on your side who stays current on real estate sales and development in your area.
- Local family law firms in Las Vegas offer a close and personal touch to their clients from their community, something you will not find if you decide to retain a lawyer from another part of Nevadaâor even from another stateâwho does not understand the culture and customs of your local area.

California Probate Process Explained
A very simplistic overview of a complex legal process and you should engage the services of a skilled attorney. Upon your attorney's recommendation, you may also be encouraged to consult with a CPA or tax consultant.
The legal process begins with a "petition" (request) to open the estate and formally name a personal representative who is responsible for the administration of the deceased's property. An Official Notice of Creditors is printed in a local newspaper and a Notice of Administration is sent to other involved parties. Creditors then have a set amount of time to file their claims based on the date of first publication. The personal representative then pays the debt and distributes the remaining estate. Finally, a petition for discharge is filed, and the estate is closed.
This California process is a bit more confusing but consulting with a probate attorney is highly recommended. Make sure you hire a reputable attorney to help you through this process.
