Common Types of Medical Malpractice

Although a doctor is supposed to help you, there are circumstances when the doctor that is supposed to help you, in fact, ends up harming you. Regardless of whether the effect is minor or more serious, you are a victim of medical malpractice.

It is important to understand the types of medical malpractice. Several common types of medical malpractice are provided below:

  • Inaccurate diagnosis – Your doctor diagnoses your condition incorrectly. The subsequent care you receive from an inaccurate diagnosis can be possibly very dangerous.
  • Incorrect medication – Not only could the medication be completely wrong, but the dose could also be entirely inaccurate. Moreover, if prescribed more than one medication, an error could be made with the assumption that they can be taken together.
  • Injuries during childbirth – Injuries can affect both the mother and baby. Possible causes include: inadequate pre-natal care, not recognizing signs of fetal distress, neglecting to test the fetus for genetic or physical abnormalities or improper care given with premature births
  • Errors during surgery – Injuries might occur prior to surgery during prep or during surgery. Possible actions include: injuring neighboring internal organs, incorrect type/dosage of anesthesia or operating on a part that is not supposed to be operated on
  • Anesthesia administration errors – It is imperative that the anesthesiologist is aware of previous medical conditions and gives the correct dose

Medical malpractice cases are very hard to prove so you should consult with an experienced medical malpractice attorney. Your attorney will evaluate your case and advise you if it is prudent to file a lawsuit.

Oklahoma Birth Injury – The Swim Law Firm

Birth injury in Oklahoma fall under the general medical malpractice legal category. Under Oklahoma birth injury law, there are caps on non-economic damages with an obstetric physician, but there are no caps on actual damages. For example, if you could prove $10 million in damages for future medical care for your child, that is not capped.

Parts of a Successful Birth Injury Lawsuit

The claims can only be based on negligence that caused an injury, where the injury resulted as a direct or possibly indirect result of whatever the negligence was, and then damages occurred.

In an Oklahoma Erb’s palsy lawsuit or other birth injury lawsuit, birth injury lawyer Douglas A. Swim has to prove four things: 1) the defendant had a duty, 2) they breached their duty or provided substandard care, 3) this action or inaction caused the injury (called causation), 4) and the injury resulted in damages that we can prove.

Douglas A. Swim – Oklahoma Birth Injury Lawyer

Douglas A.  Swim is the only medically trained individual that is now a practicing medical malpractice that has practiced in   obstetrical setting.  Doug is the only MD and JD attorney, and one of the few Physician assistants in Medical Malpractice Law.

When a birth injury in Oklahoma occurs, parents may not always know the extent or the permanence of the disability that will result from the injury. Sometimes they are advised to wait and see if their baby gets better. However, be careful about delaying too long before talking to a knowledgeable birth injury lawyer about the case. Not only can the details and witnesses become harder to track down after a few months, but in most cases parents only have two years to file an Oklahoma birth injury lawsuit on behalf of their child.

If you choose to wait, try not to delay longer than six months after the birth. Even if your child’s condition improves you may still have a case and your child may still need extra medical and rehabilitative care for the rest of his or her life.

Please contact our Oklahoma City law firm with questions about your legal issue. Provide as much information as possible regarding your inquiry. While this contact does not serve to establish an attorney/client relationship, it will allow our legal team to begin an assessment of your case.
