Benjamin H. Anderson is the founding member of Anderson Law Office, LLC in Cleveland, Ohio. Mr. Anderson is an experienced and well-seasoned trial lawyer who has devoted his career of almost two decades to medical malpractice, personal injury, pharmaceutical and medical device litigation and class actions. He has tried numerous cases to verdict in courts around the country and has successfully resolved hundreds of medical malpractice cases and thousands of mass tort cases involving bad drugs and bad medical products.
Mr. Anderson has significant experience handling complex class and mass tort litigation. Mr. Anderson embarked on his mass tort experience in the 1980’s with the asbestos litigation, achieving successful results for hundreds of his clients. He has also successfully tried cases as West Coast Coordinating Counsel in the Duragesic Patch litigation. He has served on the Plaintiff’s Steering Committee and the Discovery Committee of the In re: Telectronics Pacing Systems, Inc., MDL-1057 pacemaker litigation serving as co-trial counsel in a non-binding $286 million summary jury trial decision which ultimately settled for $95 million. In the In re: Diet Pill (“Fen-Phen”) litigation, MDL-1203, Mr. Anderson was on the Phentermine Discovery Committee and served as national counsel for the most severely injured fen-phen plaintiffs (“Class 2B claimants”) of that litigation. The Diet Pill Litigation was successfully resolved for $4.8 billion. Mr. Anderson handled dozens of fen-phen “opt-out” claims securing millions of dollars for individual clients who chose not to be part of the global settlement. Mr. Anderson was national counsel in the In re: Sulzer Hip litigation, MDL-1401, which resolved for over $1 billion and was also national counsel in the Crown Victoria Fuel-Fed Fire litigation, MDL 1488, against Ford Motor Company. Mr. Anderson also served in a Discovery Committee role in the In re: Vioxx litigation, MDL 1657 which settled for $4.85 billion. Mr. Anderson also represented hundreds of claimants in the Educational Testing Systems (ETS) litigation, MDL-1643 which resolved for over $11 million. Currently, Mr. Anderson is on the Discovery Committees in both the In re: Avandia litigation, MDL-1871, as well as the In re: Gadolinium-Based Contrast Agents litigation, MDL-1909.
Over the last 15 years, in addition to substantive leadership positions in class action and mass tort matters, Mr. Anderson has also been appointed to coordinate and to manage numerous mass tort document repositories containing millions of pages of documents. He has developed a high level of expertise relative to selecting, customizing, and implementing electronic document repositories for cases of all sizes. Whether locally administered or web-hosted by an outside vendor, effectively managing these technologies has been an instrumental part of Mr. Anderson’s ongoing success in the field of class action and mass tort litigation.
In the area of medical malpractice, Mr. Anderson has vast experience handling all forms of personal injury and medical malpractice cases with specific emphasis on Birth Injuries in Ohio. Mr. Anderson has achieved record settlements and verdicts for children who have sustained brain injury and Erb’s Palsy/brachial plexus injuries due to obstetrical negligence. He has settled and tried to verdict numerous seven-figure medical malpractice cases.
Mr. Anderson has spoken on numerous occasions at attorney education conferences throughout the United States in the areas of medical malpractice and mass torts and has taught trial skills to attorneys attending NITA conferences and law students on law school trial teams and in moot court competitions. Mr. Anderson is frequently asked by attorneys across the country to co-counsel on pharmaceutical cases as well as medical malpractice cases. Mr. Anderson is admitted to practice before all of the courts of California and Ohio, the U.S. District Court, Central and Northern Districts of California and the U.S. District Court, Northern District of Ohio. He is an active member of the American Association for Justice and was also appointed to the Board of Trustees for the Ohio Association for Justice which is the largest organization of trial lawyers in the State of Ohio. Mr. Anderson is very involved at Parkside Church in Chagrin Falls, Ohio, where he serves in several ministries.
